16. Eligibility of Tenderers  This invitation for tender is open to all eligible Tenderers   as mentioned below.
a)Minimum period of General experience in civil construction works shall be 5(five) years.
b) Genuine companies those who have experience of land development works worth of minimumTk.1.00 crore (one crore taka only) in a year within last five years.
c) Tenderers Cash flow, Turn over, Liquid Assets(Free fund) & Tender capacity  must be as specified in Tender Document.  Tenderers are requested to collect the information of qualifying minimum Cash flow, Turn over, Liquid Assets ( free fund) & tender capacity for respective Lot from project office before purchasing the tender.
d) Other required eligibility and conditions of the tenderer are shown in tender data sheet (TDS)  of  tender documents.

20. Special Instructions i) Each tender must be accompanied by Tender Security against the work in the form of Bank Draft or pay Order from any schedule Bank. No fixed deposit will be entertained as tender security.ii) The successful Tenderer will have to submit Performance Security as 10% of Accepted Rate as per PPA 2006 within the fourteen days of the Notification of award.iii) If any un-avoidable circumstances prevail in the date of receiving, tender will be received in the next working day at same hours.iv) All materials shall have to be procured at his own cost and arrangement (i.e. necessary dredging permission shall be obtained from Chittagong Port Authority or other related authority for this purpose & payment to be paid by the successful bidder), carried and supplied at the site by the successful bidder from the starting date. Proportionate physical progress i.e. quantity of the filling materials will be measured on pre-work & post-work Basis. No pre conditions and circumstances whatever shall be given by the successful bidder for any sort of delay in the progress of work. This project is related with the benefit and requirements of many people, so progress of the work should not be hampered in any way.v) All arrangement for filling, compacting, dumping, carrying, dredging earth etc, must be organized, managed by the bidder at his own risk and work plan must be submitted along with the tender. So contractor should have possessed necessary equipments for each Lot are as follows:
(1) Chain Dozer-2 Nos (2) Dump Truck- 20-35 Nos (3) Dredging Equipment- 2set (4) Pay-loader-2 Nos (5) Excavator – 1No (6) Roller with compactor- 2 Nos
 CDA is not liable directly or indirectly in the process. This authority will only give physical possession of the site and will make payment after completion of the works as per specification & terms of conditions.
vi) Hill cutting is strongly prohibited for the purpose of this earth filling.vii) For not starting work in ordered time or not performing works proportionately as per given time schedule, the contractor will be charged penalty for everyday delay as per PPA-2006 & PPR-2008.viii) The provision laid down in the ‘ Public Procurement Act-2006’ & Public Procurement Regulation - 2008 shall be in strict compliance.
 ix) The Tenderer must sign all pages of tender documents.x) Tender Documents containing insufficient/incomplete information will be  rejected.xi) Furnishing of any false, fake, wrong and  misleading document or information given by a Tenderer shall result in refection of his/her Tender and may lead to forfeiture of Tender Security and action  will be taken against Tenderer under Regulation –15 of PPR 2008.
xii) The procuring entity reserves the right to accept any or reject any or all tenders.
